Personal data protection policy

These principles take into account international standards for personal data protection and the appropriate technical and organizational measures required to protect the rights and freedoms of individuals in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation), and Act No. 18/2018 Coll. on Personal Data Protection (hereinafter the “Personal Data Protection Act”), effective from 25 May 2018.

Basic rights of the data subject

The data subject has the right to request access to their personal data, the right to rectification, erasure, restriction of processing, the right to object to processing, the right to data portability, the right to withdraw consent (where consent is the legal basis), and the right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic at statny.dozor@pdp.gov.sk.

The individual rights of the data subject, their application, and limitations are regulated in Chapter III of the General Data Protection Regulation and in Sections 19 to 30 of the Personal Data Protection Act. The data controller adheres to all conditions for personal data protection and informs data subjects of their rights in a simplified form in these principles.

A data subject is a natural person whose personal data is being processed.

Principles of personal data processing

When processing personal data, the data controller adheres to the principles outlined in Article 5 of the General Data Protection Regulation and Sections 6 to 12 of the Personal Data Protection Act:

  • lawfulness, fairness, and transparency: personal data is processed only lawfully, fairly, and transparently in relation to the data subject,
  • purpose limitation: personal data is collected for specific, explicit, and legitimate purposes; further processing may occur only for archiving in the public interest, scientific or historical research, or statistical purposes in accordance with Article 89(1) of the GDPR,
  • data minimization: personal data is collected only to the extent necessary, relevant, and limited to what is required for the purposes for which it is processed,
  • accuracy: the data controller has taken measures to ensure that inaccurately processed data is promptly deleted or corrected,
  • storage limitation: personal data is kept in a form that permits identification for no longer than necessary for the purposes of processing,
  • integrity and confidentiality: personal data is processed in a manner that ensures appropriate security, including protection against unauthorized or unlawful processing and accidental loss, destruction, or damage,
  • accountability: the data controller is responsible for compliance with these principles and must demonstrate compliance upon request to the Office for Personal Data Protection of the Slovak Republic.

Lawfulness of processing

The data controller processes personal data in accordance with Article 6 of the General Data Protection Regulation and Section 13 of the Personal Data Protection Act only on the basis of at least one of the following legal grounds:

  1. the data subject has given consent for one or more specific purposes;
  2. processing is necessary for the performance of a contract to which the data subject is party, or to take steps at the request of the data subject prior to entering into a contract;
  3. processing is necessary for compliance with a legal obligation to which the controller is subject;
  4. processing is necessary to protect the vital interests of the data subject or another natural person;
  5. processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority;
  6. processing is necessary for the purposes of legitimate interests pursued by the controller or a third party, except where overridden by the interests or fundamental rights and freedoms of the data subject.

If processing is based on the data subject’s consent, the controller archives such consent for the duration of data retention. Consent must be distinguished from other matters and expressed clearly in an understandable and easily accessible form. The data subject may withdraw consent at any time; withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

Purpose of processing personal data through the website

Through the website, the data controller processes personal data to contact individuals who have signed up via the contact form. The legal basis is the data subject’s consent under Article 6(1)(a) of the GDPR. Categories of data processed: name, surname, email, and phone number. Data is not transferred to other countries.
